Trademarks

The current trademark regulations in Guyana are mainly based on the Trademark Law enacted in 1952. The Guyana Registry is responsible for managing trademark affairs, and the official language is English. Trademark exclusive rights need to be obtained through registration. There are two methods for trademark registration: direct registration in the country and registration based on the UK. The trademark registration in Guyana adopts the principle of "application first". Guyana is a signatory to international intellectual property treaties such as the Paris Convention and the WIPO Convention, and has not yet joined the Madrid System. Therefore, trademark registration can only be processed through the "single country registration" method.

Trademark Registration Requirements

Guyana trademark registration is divided into two methods: direct registration in the country and registration based on the UK. The requirements for selecting goods and services in the two methods are different, and there are also significant differences in the validity period of the trademark.

Trademark Maintenance

(1) Based on UK registration Accepting multiple types of applications based on UK registration can protect goods and services. If the applicant does not reside in Guyana, they must entrust a specialized agent in their home country to handle the matter. The basic materials required for trademark application are: 1. Trademark design; 2. Specific categories and product/service items; 3. Name and address of the applicant; 4.If priority is declared, priority proof documents and corresponding translations must be provided; 5. Power of attorney; 6. Notarized UK trademark registration certificate. Based on registration in the UK, it usually takes about one year, and a registration certificate will be issued after the trademark is approved. After registration, the validity period is the same as that of UK registration, and renewal can only be processed after UK registration renewal. (2) Directly registered in the country The country does not accept multiple types of applications for direct registration, and can only protect commodity projects. Service categories cannot be applied for temporarily. If the applicant does not reside in Guyana, they must entrust a specialized agent in their home country to handle the matter. The basic materials required for trademark application are: 1. Trademark design; 2. Specific categories and product/service items; 3. Name and address of the applicant; 4. Power of attorney; 5.If priority is declared, priority proof documents and corresponding translations must be provided. The main process for direct registration in the country is: application - examination - announcement (1 month) - approval - issuance of certificates. Direct registration in this country generally takes 12-18 months. Valid for 7 years after registration, starting from the date of application; Renewal can be processed one month before the expiration date, with a grace period of one month and a validity period of 14 years.
